Privacy Policy

1. Purpose and Scope
Simple Platform LLC, including its subsidiaries and affiliates (collectively, "Simple Platform," "we," "us," or "our"), respects your privacy.
This Privacy Policy applies to our collection, use, and disclosure of information we process as a data controller. This includes information obtained in connection with your use of our public websites (such as simple.dev), community forums, support portals, partner portals, and other ancillary services (collectively, the "Websites"). It also applies to account management and billing information we process as a controller in relation to our subscription services.
This Privacy Policy does not apply to the "Customer Data" (as defined in our Master Subscription Service Agreement) that we process on behalf of our Customers in our role as a data processor when providing our subscription platform and applications (the "Service"). Our Customers act as the data controllers for the Customer Data they upload to the Service, and our processing of that data is governed by the data processing addendum and other terms in our agreements with them.
2. Definitions
Capitalized terms used in this Policy are defined in our Master Subscription Service Agreement and have the same meaning here. For convenience, key terms include:
- “Customer” means the entity that purchases our Service.
- "Customer Data" means all electronic data, information, or material, including Personal Data, provided, submitted, generated, or managed by Customer or its Authorized Users to or through the Service.
- “Account Data” means billing information and contact information for a Customer or Partner’s designated representatives.
- “Usage Data” means data relating to the provision, use, and performance of our Service and Websites, which does not include Customer Data.
- “User” means an individual authorized by a Customer to access and use the Service.
3. How We Obtain Information
We collect information in the following ways:
- Information You Provide: We collect information you provide directly to us, such as when you create an account for our Websites, request a demo, contact support, or otherwise communicate with us. This may include your name, email address, job title, and company name.
- Account Data: We collect Account Data from our Customers and Partners for billing, account management, and contracting purposes.
- Usage Data: We automatically collect Usage Data when you interact with our Websites and Service. This may include information about your device, IP address, browser type, operating system, pages viewed, and session duration. We may use third-party analytics services, such as Google Analytics, to help us collect and analyze this data.
- Mobile Applications: If you use our Mobile Applications, we may collect information about your device, operating system, location, and interaction with the application to provide and improve our services.
4. How We Use Information
We use the information we collect as a data controller for several business purposes:
- To operate, maintain, and improve our Websites and Service.
- To process transactions, manage accounts, and send related information, including invoices and technical notices.
- To respond to your comments, questions, and requests, and to provide customer service and support.
- To communicate with you about products, services, offers, and events offered by Simple Platform.
- To monitor and analyze trends, usage, and activities in connection with our Websites and Service.
- To enforce our legal rights, comply with legal obligations, and for other business purposes like industry analysis and benchmarking.
AI and Machine Learning: As stated in our Master Subscription Service Agreement, we willnot use Customer Data to train our general, multi-tenant AI models that serve other customers. Customer Data may be processed by AI Features (e.g., LLMs) solely to provide the contracted functionality to that Customer within their instance of the Service.
5. How We Disclose Information
We may disclose personal data covered by this Policy to the following categories of recipients:
- Affiliates and Subsidiaries: To our corporate affiliates and subsidiaries as necessary for the purposes outlined above.
- Service Providers and Subcontractors: To third-party service providers who perform services on our behalf, such as cloud hosting providers (e.g., Microsoft Azure, Google Cloud Platform), payment processors, and analytics providers. We remain responsible for their compliance with our privacy obligations.
- Business Transfers: In connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- Legal Requirements: To any competent law enforcement body, regulatory, government agency, court, or other third party where we believe disclosure is necessary to (i) comply with a legal obligation, (ii) protect the vital interests of any person, or (iii) exercise, establish, or defend our legal rights.
- With Consent: To any other person with your consent to the disclosure.
6. Data Security
As outlined in our Master Subscription Service Agreement, we implement and maintain commercially reasonable and industry-standard administrative, physical, and technical safeguards designed to protect the security, confidentiality, and integrity of data. This includes measures such as encryption of data at rest and in transit and maintaining a disaster recovery plan.
7. Your Privacy Rights and Choices
In accordance with applicable laws, you may have the right to request access to, correction of, or deletion of your personal data that we hold as a data controller. You may also have the right to object to or restrict certain processing of your personal data.
To exercise any of these rights, please contact us. We will respond to your request in accordance with applicable data protection laws. We may need to verify your identity before fulfilling your request.
Please note that if your request pertains to Customer Data for which we are a data processor, we will direct you to contact the relevant Customer (the data controller).
8. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the revised policy on our Websites and, in some cases, providing more prominent notice (such as by sending you a notification).
