Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the services provided by Simple Platform LLC ("Provider," "we," "us," or "our"), including the Simple Platform, Simple CRM, Simple Call Center, any custom-developed applications, AI Agents, and any related software or services (collectively, the "Service"). This AUP is incorporated by reference into our Master Subscription Service Agreement ("Agreement").

By using the Service, you agree to comply with this AUP. We may modify this AUP at any time by posting a revised version on our website. Your continued use of the Service after a modification constitutes your acceptance of the revised AUP.

Prohibited Uses

You may not use, or encourage, promote, facilitate, or instruct others to use, the Service for any illegal, harmful, fraudulent, infringing, or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing, or offensive. The following are non-exhaustive examples of prohibited uses:

1. Illegal, Harmful, or Fraudulent Activities

Any activities that are illegal, that promote illegal acts, or that violate the rights of others. This includes, but is not limited to:

• Activities that are fraudulent, libelous, defamatory, or deceptive, such as phishing, pharming, or impersonating any person or entity.
• Promoting or facilitating pyramid schemes or other illegal business practices.
• Exploiting, harming, or attempting to exploit or harm minors in any way.
• Transmitting, distributing, or storing any material that is in violation of any applicable law or regulation, including those concerning child pornography, gambling, or obscenity.

2. Infringing Content

Content that infringes or misappropriates the intellectual property or proprietary rights of others. This includes:

• Using, transmitting, or distributing any content or material for which you do not have all necessary rights, licenses, consents, and permissions.
• Violating, or encouraging the violation of, the intellectual property rights of others, including copyrights, patents, trademarks, or trade secrets.

3. Security and Network Integrity Violations

Activities that compromise the security, integrity, or performance of the Service, our network, or any other network or system. This includes:

• Introducing any viruses, malware, worms, Trojan horses, or other malicious or technologically harmful code into the Service.
• Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
• Probing, scanning, or testing the vulnerability of the Service or any system or network without proper authorization.
• Circumventing or attempting to circumvent any user authentication or security measures of any host, network, or account.
• Reverse-engineering, decompiling, or disassembling any aspect of the Service, except to the extent that such activity is expressly permitted by applicable law.

4. Spam and Unsolicited Communications

Generating or facilitating unsolicited commercial email ("spam") or other communications. This includes:

• Sending any unsolicited or unauthorized advertising, promotional materials, or any other form of similar solicitation.
• Violating any applicable laws and regulations regarding the sending of electronic communications, such as the CAN-SPAM Act or the Telephone Consumer Protection Act (TCPA).
• Using the Service to collect replies to messages sent from another internet service provider if those messages violate this AUP or the acceptable use policy of that provider.

5. Abusive Use and Resource Consumption

Any use of the Service that creates a disproportionate burden on our infrastructure or interferes with the normal operation of the Service for other users. This includes:

• Activities that consume an excessive amount of CPU, memory, storage, or network bandwidth that is inconsistent with normal business use and that may degrade the performance of the Service for others.
• Using the Service in a manner that constitutes a denial-of-service attack or any other activity that could overload, damage, or impair the Service.

6. Specific Prohibitions for AI Features

In addition to the above, you may not use any AI Agents, Large Language Models (LLMs), or other artificial intelligence features of the Service to:

• Generate or disseminate misinformation, disinformation, or content that is intentionally deceptive.
• Create or distribute hate speech, harassing content, or content that promotes violence against any individual or group.
• Develop models, tools, or services that compete with Simple Platform LLC.
• Use the Service for decision-making in high-stakes domains without appropriate human oversight, such as in legal, financial, or medical advice contexts.
• Attempt to "jailbreak," probe, or otherwise manipulate the safety and alignment features of the AI models.

7. High-Risk Use

You may not use the Service in any situation where the failure of the Service could lead to death, personal injury, or severe physical or environmental damage. This includes, but is not limited to, the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems.

Enforcement

We reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the Service. In our sole discretion, we may take any of the following actions:

• Issue warnings, either written or verbal.
• Suspend or terminate your access to the Service, in whole or in part, with or without notice.
• Remove or refuse to transmit any of your content that violates this AUP.
• Report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties, and cooperate with them in any investigation.

If your access to the Service is suspended or terminated as a result of a violation of this AUP, you will not be entitled to any credits or refunds for any prepaid fees.

Reporting Violations

If you become aware of any violation of this AUP, you agree to immediately notify us and provide us with assistance, as requested, to stop or remedy the violation. To report any violation, please email us at abuse@simple.dev.
